Terms of Service

These Terms of Service (the “Terms”) are an agreement between you and PİXİR YAZILIM DANIŞMANLIK PAZARLAMA LTD. ŞTİ., the company that operates the Narvin service (“Narvin,” “we,” “us,” or “our”). They govern your access to and use of the websites, applications, monitoring, alerting, and reporting features we provide (collectively, the “Service”).

By creating an account or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you use the Service on behalf of a company or other legal entity, you represent that you have authority to bind that entity, and “you” refers to it. If you do not agree, do not use the Service.

Narvin monitors websites and related infrastructure that you configure — including uptime and response-time checks, SSL certificate and domain-registration tracking, DNS-change detection, page-speed measurements, heartbeat (cron) monitors, and public status pages — and delivers alerts and reports to the destinations you choose.

The Service also includes optional AI-assisted client reports: narrative summaries generated from your monitoring data and, where you connect them, third-party analytics sources. Section 6 sets out additional terms for that feature.

We continually improve the Service and may add, change, or remove features. Where a change materially reduces the functionality of a paid plan, we will use reasonable efforts to notify you in advance.

• You must be at least 16 years old and able to form a binding contract to use the Service. The Service is intended for business and professional use.
• You must provide accurate account information and keep it up to date. You are responsible for safeguarding your credentials and for all activity that occurs under your account.
• Notify us promptly at support@narvin.io if you suspect unauthorized use of your account.

The Service offers a free plan and paid subscription plans. The features and limits of each plan are described on our pricing page and may evolve over time.

• Merchant of record. Paid subscriptions are sold and billed by Paddle, our merchant of record. Your purchase is also subject to Paddle’s checkout terms, and invoices, taxes, and payment handling are managed by Paddle.
• Renewal. Subscriptions renew automatically at the end of each billing period until cancelled. You can cancel at any time from your billing settings; cancellation takes effect at the end of the current period.
• Refunds. If something has gone wrong, contact support@narvin.iowithin 14 days of a charge and we will review refund requests in good faith, alongside any rights you have under applicable consumer law and Paddle’s buyer terms.
• Price changes. We may change prices or plan limits with reasonable advance notice; changes apply from your next billing period.
• Free plan. The free plan is provided as-is, may be subject to fair-use limits, and may change over time.

You agree that you will not:

• Monitor websites, endpoints, or systems that you do not own or lack authorization to monitor.
• Use the Service to probe, scan, overload, or attack systems, to circumvent rate limits or plan limits, or to interfere with the Service’s operation or other customers’ use of it.
• Use alerts, reports, or messaging channels delivered through the Service to send spam or unlawful content, or to message recipients who have not consented to receive them.
• Resell or provide access to the Service except as the plan you purchased expressly allows (for example, sharing reports with your own clients).
• Use the Service in violation of applicable law, or attempt to reverse engineer non-public parts of the Service except where permitted by law.

We may suspend or limit accounts that violate this section, where practicable with notice.

Some reports are generated with the assistance of large language models from your monitoring data and any analytics sources you connect. For this feature:

• Your review. You are responsible for reviewing AI-generated reports before relying on them or sending them to your own clients. Where the Service offers an approval step, it exists for this purpose.
• No professional advice. Report narratives and recommendations are informational. They are not engineering, legal, financial, or other professional advice, and we make no warranty that following them will achieve any particular result.
• Your data, your reports. As between you and us, you retain your rights in the monitoring and analytics data you provide, and you may use the reports generated for you — including sharing them with your clients under your own branding where your plan includes that capability.
• Usage limits. AI report generation is subject to the monthly quotas of your plan.

We operate the Service with commercially reasonable skill and care and aim for high availability, but we do not promise that the Service will be uninterrupted or error-free, and no service-level agreement applies unless we have agreed one with you in writing. Monitoring results, alerts, and reports depend in part on third-party networks and providers that we do not control, and the free plan is provided without any support or availability commitment.

We and our licensors own the Service, including its software, design, and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms and your plan. You may not use the Narvin name or logo without our prior written consent, except to state truthfully that you use the Service.

If you send us feedback or suggestions, you grant us a perpetual, royalty-free licence to use them without restriction.

• By you. You may stop using the Service and close your account at any time.
• By us. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if we discontinue the Service; where practicable we will give you reasonable notice and an opportunity to export your data.
• On termination, your right to use the Service ends and we delete or anonymize your data in accordance with our Privacy Policy and retention rules.

To the maximum extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that every incident will be detected or that every alert or report will be delivered or accurate.

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data. Our total aggregate liability arising out of or relating to the Service is limited to the amounts you paid us for the Service in the twelve months before the event giving rise to the claim (or, for free-plan use, USD 50). Nothing in these Terms excludes liability that cannot be excluded under applicable law, including mandatory consumer protections in your country of residence.

These Terms are governed by the laws of the Republic of Türkiye, and the courts and enforcement offices of Ankara, Türkiye have exclusive jurisdiction over disputes arising from them — without prejudice to any mandatory consumer rights or forum protections you enjoy under the laws of your country of residence.

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date at the top of this page and, where appropriate, notify you through the Service or by email. Your continued use of the Service after an update means you accept the revised Terms.
